REGULATORY UPDATE ON INSURANCE

The Act regulating the insurance and reinsurance sector in Portugal has been modified to meet EU requirements. The goal of these modifications is to improve insured satisfaction and deal more efficiently with claims. To this end, the local regulator will:

a) Establish clear guidelines for a unified regulatory approach towards policyholders, insureds, beneficiaries, and aggrieved third parties.

b) Create an autonomous entity responsible for the management of claims derived from acts or omissions of insurers, which will be headed by an Insurance Ombudsman yet to be appointed, who will assist policyholders, insureds, beneficiaries or third parties with their complaints against insurers.

c) To create a fraud prevention scheme to prevent, detect and report scams.

Insurers must provide all required information in a timely and impartial manner, at no cost to the claimant.

The Act also refers to an antifraud policy stating its basic principles and minimum content. The antifraud policy should be presented in a written document and establish mechanisms of information and valuation of risks. In addition training programs for collaborating agents shall be implemented and a registry of suspicious conducts has to be set up.
